Terms of Service

1. Acceptance of terms

By creating an account or using PromptMind (the "Service"), operated by PromptMind Ltd ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, do not use the Service. These Terms apply to all users, including free and paid subscribers.

2. Service description

PromptMind is an AI-powered prompt generation tool that scrapes publicly accessible URLs, classifies their content, and generates contextual AI prompts tailored to the page type and your persona configuration. The Service includes prompt execution, playbook management, URL monitoring, bulk processing (on applicable plans), and team collaboration features.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. Features available on your plan are described in our pricing documentation and may be updated as new features are added.

3. Acceptable use

You agree to use the Service only for lawful purposes. You must not:

• Submit URLs to content you do not have the right to analyse (e.g. paywalled content, private portals)
• Use the Service to generate content that is defamatory, harassing, or illegal
• Attempt to reverse engineer, scrape, or abuse the API beyond your plan limits
• Resell or sublicense access to the Service without prior written agreement
• Use automated scripts to submit URLs in bulk without an active Agency plan and API access
• Attempt to circumvent rate limits, usage limits, or plan restrictions
• Use the Service to train competing AI models or prompt generation systems

We reserve the right to suspend or terminate accounts that violate these policies without notice or refund.

4. Subscriptions and billing

Paid plans are billed monthly or annually in advance via Stripe. Prices are displayed in GBP (£). All prices are exclusive of VAT; applicable VAT will be added at checkout based on your billing country.

Your subscription renews automatically at the end of each billing period unless cancelled. You may cancel at any time through your account settings or by contacting us at hello@promptmind.uk. Cancellation takes effect at the end of your current billing period; you retain access until that date.

We offer a 7-day money-back guarantee for first-time paid subscribers. Refund requests must be submitted within 7 days of the initial charge by emailing hello@promptmind.uk. Subsequent renewals are non-refundable unless required by applicable law.

We may change pricing with 30 days' notice. Price changes take effect at your next renewal. If you do not agree with a price change, you may cancel before it takes effect.

5. Data handling and privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described therein.

URL content submitted for analysis is processed transiently by our scraping provider (FireCrawl) and AI provider (Anthropic). Scraped content is retained in our database for 30 days to support re-analysis, after which it is automatically purged. Analysis metadata (page type, classification, generated prompts) is retained as part of your account history.

We do not use your submitted URLs, scraped content, or generated prompts to train our AI models or any third-party models.

6. Intellectual property

You retain full ownership of any prompts you create, save, or export using the Service. The AI-generated prompt templates provided by PromptMind are licensed to you for use in your business; you may not republish them as standalone products or services competing with PromptMind.

The PromptMind platform, including its UI, algorithms, prompt template library, and branding, is the exclusive intellectual property of PromptMind Ltd. All rights not expressly granted are reserved.

Third-party content scraped via publicly accessible URLs remains the intellectual property of its respective owners. PromptMind is a tool to help you understand and respond to that content — not to reproduce or republish it at scale.

7. API usage

API access is available on Pro and Agency plans. API usage counts against your plan's monthly analysis limit. You must keep your API key confidential and are responsible for all activity under your key. Do not share your API key or embed it in public-facing client-side code.

We enforce rate limits to ensure fair usage across all users. Exceeding rate limits will result in temporary throttling. Persistent abuse of the API may result in account suspension. Current rate limits are documented in our API documentation.

8. Team accounts

Team features are available on the Agency plan. The account owner is responsible for all activity by team members, including compliance with these Terms and any applicable laws. Team seats are non-transferable and may not be shared between individuals.

Removing a team member immediately revokes their access to the workspace. Shared playbooks and analyses created by removed members remain in the workspace and become the property of the team owner.

9. Termination

You may terminate your account at any time from Settings > Account. Upon termination, your data will be retained for 30 days in case of accidental deletion, after which it will be permanently deleted.

We may suspend or terminate your account immediately if: (a) you breach these Terms, (b) we are required to do so by law, or (c) we reasonably believe your use poses a risk to other users or the platform. In case of termination for breach, no refunds will be issued.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate, complete, or suitable for any particular purpose.

AI-generated prompts are tools to assist you — they are not professional legal, financial, medical, or strategic advice. You are solely responsible for how you use the output of the Service.

11. Limitation of liability

To the maximum extent permitted by law, PromptMind Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising from your use of or inability to use the Service.

Our total aggregate liability to you for any claim arising from these Terms or your use of the Service shall not exceed the total amounts paid by you to us in the 12 months preceding the claim, or £100, whichever is greater.

12. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or related to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before initiating any formal legal proceedings, we encourage you to contact us at hello@promptmind.uk to attempt to resolve the dispute informally. We will make reasonable efforts to address your concerns within 30 days.

13. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice in the app at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
